Indonesia: Is Women-Only Transport Effective?

Kereta pagi meluncur dari stasiun Manggarai menuju stasiun tanah abang.  Di dalam penumpang kereta yang berdesak-desakkan, terdapat Agnes yang hendak berangkat menuju kantor.  Tiba-tiba dari arah belakang dia merasakan sesuatu yang aneh.  Sontak ia segera berbalik badan dan dengan lantang berteriak ke muka pria yang tepat berdiri di belakangnya,”Heh! Kamu sengaja ya gesek-gesek?!” Pria tersebut tidak bisa mengelak dan di stasiun berikutnya dia pun diturunkan oleh petugas dan dilaporkan pada pihak berwenenang.

Kisah diatas merupakan ilustrasi dari kejadian pelecehan seksual yang kerap terjadi di transportasi umum di Indonesia.  Banyaknya pengguna kereta di pagi hari mengakibatkan hal-hal seperti ini terkadang sulit dihindari.  Kejadian pelecehan seksual seperti yang terjadi pada KRL juga terjadi pada penumpang wanita Bis Trans Jakarta.    Beruntung pemerintah cukup peduli dengan hal tersebut.  PT Kereta Api Indonesia melalui PT KAI Commuter Jabodetabek (KCJ) terhitung sejak tanggal 1 Oktober 2012 meresmikan kereta khusus wanita.  Gerbong khusus ini biasanya terdapat pada gerbong pertama dan gerbong terakhir dari rangkaian KRL.  Selain pada transportasi kereta api, transportasi umum lainnya yang juga terdapat area khusus wanita adalah Bis Trans Jakarta.  Bis Trans Jakarta juga merupakan sarana umum yang kerap digunakan oleh para pekerja setiap harinya.  Dengan adanya area-area khusus wanita tersebut dapat pemerintah Indonesia melalui PT KCJ  seperti yang diungkapkan oleh Eva Chairunissa selaku VP Communications PT KCJ dapat mengakomodasi permintaan para pengguna KRL yang merasa risih harus berdempet-dempetan dengan lawan jenis.  Selain itu ia juga mengharapkan agar dengan adanya gerbong khusus wanita dapat menghindari kejadian-kejadian yang tidak diharapkan yang korbannya lebih sering perempuan. Saya sebagai salah satu pengguna reguler KRL sangat mengapresiasi tindakan pemerintah dalam mengurangi pelecehan seksual terhadap pengguna wanita baik di kereta maupun di Bis.  Kejadian seperti ilustrasi kisah diatas memang sangat mengganggu bahkan cenderung menjadi terror yang cukup menakutkan bagi sebagian wanita terutama para korban dari tindakan asusila tersebut.  Saya merasa cukup beruntung tidak pernah mengalami kejadian ini.  Dalam pengamatan saya membaca berita-berita, semenjak diadakannya area khusus wanita baik pada kereta api maupun bis trans Jakarta, kasus pelecehan seksual pada transportasi umum tidak sebanyak sebelumnya. Namun apakah hal ini bisa dibilang efektif untuk menanggulangi kasus-kasus pelecehan seksual yang terjadi pada sarana transporasi umum?  Saya rasa hal ini masih harus dikaji lebih dalam.  Coba sama-sama kita bayangkan.  Untuk merasa lebih aman, pengguna kereta wanita yang jumlahnya bisa mencapai puluhan bahkan ratusan ribu per harinya harus rela berdesak-desakkan dalam 2 gerbong yang tersedia.  Berita-berita terakhir bahkan menunjukkan kejadian tidak mengenakkan di gerbong wanita seperti adu mulut berebut tempat duduk.  Sehingga akhirnya sebagian dari mereka tetap menggunakan gerbong biasa dengan resiko bisa mengalami kejadian pelecehan seksual.  Dan apabila memang terjadi, akankah mereka disalahkan karena ‘memilih dengan sengaja’ gerbong yang bukan dikhususkan untuk wanita?

Buat saya kejelasan hukum juga menjadi poin penting dalam rangka pencegahan kasus pelecehan seksual tersebut.  Dari penelitian singkat saya mengenai kasus-kasus pelecehan seksual yang terjadi di transportasi umum, pelaku tidak mendapat hukum yang setimpal, bahkan dalam beberapa kasus dibebaskan karena dianggap ‘hanya’ melakukan percobaan.  Bukankah segala sesuatu itu berawal dari ‘mencoba’?  Kalau berhasil diteruskan.  Justru titik krusial menurut saya adalah pada saat mencoba ini.  Jika dari hal ini saja sudah ‘dibolehkan’ secara hukum maka jangan heran kalau kasus pelecehan seksual masih akan dan terus berlangsung di transportasi umum.  Sejauh ini saya belum menemukan hukuman yang dapat memberikan efek jera kepada para pelaku kejahatan seksual tersebut.  Sekali lagi seperti yang pernah saya tulis sebelumnya, hal ini masih belum dianggap serius.  Padahal efek yang ditimbulkan kepada para korban sangat dalam.  Berdasarkan laman resmi dari Komnas Perempuan (komnasperempuan.go.id) pelecehan seksual dikategorikan ‘hanya’ sebagai perbuatan yang tidak menyenangkan dalam hukum Indonesia.  Hal inilah menurut saya yang masih perlu perbaikan.

Upaya pemerintah dengan mengadakan area khusus wanita pada transportasi umum patut kita hargai.  Setidaknya pemerintah masih peduli terhadap kasus-kasus pelecehan seksual yang kerap terjadi pada pengguna wanita.  Namun alangkah baiknya apabila langkah yang sudah baik ini diikuti pula dengan payung hukum yang sepadan.  Kita semua juga tahu tidak mungkin semua penumpang wanita berada di area khusus wanita.  Sebagian akan tetap berada di area umum.  Dengan hukum yang jelas dan bisa menimbulkan efek jera, akan sangat menunjang usaha pengurangan tingkat pelecehan seksual di area publik dan transportasi umum.  Jika tidak maka jangan heran apabila kejadian seperti akan tetap berlangsung tanpa dapat dicegah.

The morning train is on its way from Manggarai station to Tanah Abang station.  Among those many people, there was Agnes who is on her way to the office.  Suddenly she feels something disturbing.  She quickly turns her body angrily and yells at the man standing behind her, “Hei! Are you intentionally touching my back with your p***s?! The man cannot avoid the accusation and in the next station he is brought to the post for further process.

The above story is an illustration of how the sexual harassment happens on public transportation in Indonesia. The crowds of people using the trains and buses in their daily morning makes that behavior seems unavoidable.

Luckily the government has shown their concern towards this matter. Since October 1, 2012, PT Kereta Api Indonesia (Indonesian Train Company) through PT KAI COMMUTER JABODETABEK (KCJ) has run women-only transit carriages in the front and back of the train.  In addition to the train, the trans-Jakarta bus, which is also a common mode of transportation, has a special area for women, the first few rows behind the driver.

Eva Chairunissa, the VP Communications of PT KCJ, said the women-only areas are meant to help women riders feel more comfortable. The government hopes that the women-only areas are decreasing the levels of sexual harassment and that people are more comfortable using the public transportation.

I, as one of the public transportation user, really appreciate what the government has done in order to reduce the level of sexual harassment in public transportation. I am lucky enough to never have experienced such an incident, but based on what I’ve read in the news, the sexual harassment cases have gone down since the launch of the women-only areas.

However is it really effective at decreasing the level of sexual harassment in public transportation?  I think it still needs to be reviewed.  Let’s imagine.  To feel more comfortable and safe, women passengers, who are up to hundreds of thousands in number each day have to use only two carriages on the train or the first few rows on the trans-Jakarta bus.  There is simply not enough space for all women and there are often arguments over seating. Thus, many women still use the regular area in the public transportation and face the risk of experiencing sexual harassment there.  And of course if and when that happens, some may blame them for choosing the “wrong” area.

In my opinion, women-only options are not enough. The clarity of the law is also very important in order to prevent sexual harassment.  From my own research of news stories, the punishment for the perpetrators are not worth it, even in some cases they are not being punished because they were ‘only’ just ‘trying’ to sexually harass the victim…. But doesn’t everything start from trying? If they succeed, they may do it again. The crucial moment for me is at the stage of ‘trying’. If this stage is ‘allowed’ according to law, then no wonder sexual harassment cases in public transportation still occur.  Thus far, I haven’t found any punishment that would realistically act as a deterrent to the perpetrators.  Once again, as my two last articles had stated, this kind of behavior has not yet been taken seriously.

Based on the KOMNAS PEREMPUAN (National Commission On Violence Against Women) website, by law, sexual harassment is categorized only as a “disturbing behavior” that is on the same level as other behavior, such as cheating. This is what needs to be improved.  The current sexual harassment law is not at all adequate to accommodate the range of every day behaviors.

The government’s plan for preventing sexual harassment in public transportation by creating women-only areas is well-respected.  At least the government has done something.  However, it would be much better if this action was accompanied with a decent law, especially as many women still use the regular sections of public transportation. Therefore a stronger law will help reduce the sexual harassment cases on a larger scale in public spaces, including public transportation.  Otherwise, we can’t be surprised when sexual harassment incidents continue to occur.

India: Uber Installs Panic Buttons and Feminists Call for Freedom from Fear

“When I walk down the streets I put on my death stare and scan every man´s face, I pass by. Their eyes are not on my face, but all over my body. I hold my head high and my hands make a fist. I am ready to fight anyone who comes near me. I am afraid, but more than that I am angry, really angry,” one young woman in Delhi tells me.

We actually talked about something else entirely, but when two women in Delhi meet, the conversation almost always turns to harassment and how to deal with it. Safety and freedom are the buzzwords we throw in. In the absence of both, these big words become tiny demands for dignity.

“I want to ride the metro in the middle of the night – unaccompanied and without a knot in my stomach“ a woman tells me.

Another one wants “to explore unknown neighborhoods and enjoy sights, admire their beauty and get lost in the crowds in narrow lanes.” But they say they cannot. With all the responsibility for their own safety put on them – What did you wear? Where did you go? Did you send a screenshot of your Uber ride to a friend? How late was it? Did you drink? Were you alone? What did you say? – there is little energy left to enjoy a stroll through the city.

Women are conscious about what to wear, which route to take, who to ask for directions and what mode of transport to take. Being on guard constantly is work, which drains lots of energy. This work is neither acknowledged nor rewarded. Still women are blamed if they don’t do “their part”. The regular obnoxious and very offensive rape analogies spit up by politicians and judges every now and then reinforce the idea that women are solely in charge for their safety and perpetrators cannot help themselves. It also sends a very clear message to all women: You are in this alone. Society will not change and no one will help you.

And of course this narrative is also offensive to men, dehumanizing them as out of control and overpowered by urges. Weirdly men do not seem to be bothered by that.

The focus remains on women: There are women-only compartments in metros and buses. A liquor store has a women-only section and advertises harassment-free alcohol shopping. This way men will never have to get used to the existence of women in public. Uber has safety buttons in their cars. From January 2017 onwards, all mobile phones in India are required to have a safety button. The pepper spray sold in shops and via amazon comes in a pink design. There also are plenty of apps which crowdsource safer ways home or send alerts and emergency texts and your GPS to your contacts. Technology and the market adapt to any tragedy.

While all of these may have value as short term solution, they are also distractions, adding more to the list women feel they must do for their own safety. Women´s physical and psychological well-being become collateral damage. Why don’t you have the app? Why didn’t you buy that new phone? Why did you get into the Uber without checking if it has the button already? Why didn’t you take that self-defense class? All this easily leads to: Why don’t you stay at home?

There is another way to approach safety concerns. Various feminist initiatives show victim-blaming the finger, change the discourse about responsibility and encourage fear to be turned into anger and confidence.

leaveThe campaign #HaveShortsWillSmoke by ”the spoilt modern Indian woman” asks women to share pictures of them wearing shorts or skirts and having a drink or smoking and share the comments they got in public. The initiative Blank Noise exhibits clothing of women, they wore when they were harassed. Of course, all kinds of clothes are represented, debunking the myth that covering up is a solution. #Walkalone and #FreeFromFear are the hashtags women use to demonstrate how they took a route, which they walked despite being afraid. Blank Noise declares them to be Sheroes, as they do not let fear influence their mobility and independence. Safecity started documenting areas that feel safe in order to encourage more women to come out and make the area even safer.

These are small steps and low-scale initiatives not having a big impact one might argue. But as opposed to the above mentioned “security measures”, which not only rely but bet on women´s fear do not even scratch the surface of the problem, but sustain the status quo, these feminist ideas provide a much-needed refreshing and creative input that inspires courage, anger and action. Chariots for Hire, No Groping Buttons and Other Ways to Make Transit Safer

The ride-sharing service Chariots for Women will be launching nationwide on April 19 as an alternative to Uber and Lyft. In this model, all drivers and customers will be women to “ensure safety, comfort, and pleasure.”

Since stories about sexual violence of women at the hands of male Uber and Lyft drivers and taxi drivers are not uncommon, it’s understandable that there is a market for such a service. Indeed, I’ve supported a similar but free service called RightRides in both New York City and Washington, D.C. On select nights, women and LGBQTI-identified people can receive a safe, affordable late-night-ride home.

In San Francisco, a similar service called Homobiles offers rides that are free, with a donation suggested, to members of the LGBTIQQ community, who similarly may feel unsafe or discriminated against by drivers or be unable to pay for expensive taxi fares.

I understand why these services exist and many countries offer some form of women-only public transportation. But I do not believe that these kinds of women-only or LGBTIQQ-only services should be the ultimate goal. They are problematic for many reasons. Namely, they do not address the root causes of harassment and sexual assault, and they place the onus on these communities to keep themselves safe.

But there are no quick-fixes and easy answers for making public transportation (or any public spaces) safer, and I applaud those who are at least trying. And lately, there have been many groups that are trying. These are four examples, just from the past few weeks:

 

JAPAN:

In Japan, men groping women and girls on public transportation is a problem, but it’s challenging for them, especially girls, to speak out in the moment when it happens.

A female high school student in Tokyo who was regularly groped by men on her ride home from school (and reported it, but that did not stop it) and her mother designed a button that said “Groping is a crime” and “I won’t let the matter drop” which she attached to her school bag. The buttons seem to be a deterrent, and no man has groped her since she put them on her bag.

Her success inspired others. Recently, thanks to a fundraising campaign (“Stop Chikan Badge Project”), the Chikan Yokushi Katsudo Center expanded on her idea and mass produced buttons. The designs on the buttons were also selected through crowdsourcing – there were 441 submissions and five designs selected. Recently, volunteers from the organization distributed 500 of the buttons at the JR Shibuya Station, with plans to distribute them at other stations. Not only did girls and young women take badges, but adults took them too to distribute to their daughters.

MEXICO:

In early April, twenty women wearing dark clothing across their body and faces held a flash mob protest against sexual harassment on the transit system in Mexico City. They were organized by the group Information Group on Reproductive Choice after one of the women’s colleagues was attacked. A 2014 study found that more than 60 percent of women in Mexico City and faced sexual abuse while riding public transit.

The women demonstrated at various stations and on the subway itself. Both metro authority staff and passengers were respectful and many women passengers stopped to thank them for raising awareness through their demonstration.

UK:

Transport London conducted a survey in 2013 of their riders and found that around one in seven women had experienced unwanted sexual behavior on public transit. In response, they launched Project Guardian in conjunction with the British Transport, Metropolitan and City of London police forces and local advocacy groups, to raise awareness and train employees. But even still, few people reported harassment when they experienced it.

One year ago, they released the Report It to Stop It campaign. The video captures the way harassment can escalate and a voice asks at various points, “Would you report it?”

This month, one year later, Siwan Hayward, TfL’s deputy director of enforcement and on-street operations said there’s “not enough data yet to say it’s a trend” but “we are beginning to see what we hope is actually the prevalence of sexual offences falling.”

Notably, the video has been viewed nearly five million times and 36 percent more people are coming forward to report harassment, resulting in a 40 percent increase in arrests. As Ellie Violet Bramley wrote for the Guardian, “the real win is the cultural shift this signals – women won’t accept this behaviour as routine any more, and neither will the authorities.”

USA:

Washington Metropolitan Area Transit Authority (WMATA) has been working in collaboration with Collective Action for Safe Spaces and Stop Street Harassment on an anti-harassment campaign that has included station-wide awareness posters, an online reporting form, the training of employees, and outreach days at Metro stations. All of these efforts set the tone that sexual harassment is unacceptable and is taken seriously.

Over International Anti-Street Harassment Week, the three organizations released the results of the first-ever survey on the system. This is the biggest study of its kind for any transit system in the United States.

In the 1,000 person-regionally representative survey conducted in January 2016 by Shugoll Research, 21 percent of riders had experienced some form of sexual harassment, with verbal harassment being the most common form. Women were three times more likely than men to experience sexual harassment.

In positive news, 41 percent of the riders were familiar with the latest anti-harassment campaign and those who were familiar with it were twice as likely to report their experiences of harassment. Based on the findings, WMATA, CASS and SSH are currently working on a new awareness campaign that will be released in a few weeks.

Germany: Women-Only Transit Options

women_only_public_transportIn more than one dozen countries, women-only public transportation is chosen as a short-term (or mid-term!) solution to street harassment. These countries are as diverse as Japan, India, Brazil, the Philippines and UAE, and offer sex segregated compartments in their trains or subways. In India public buses have benches reserved for women, entire trains for women and a women-only carriage in the Delhi metro. On the platform of the metro stop, the pink sign marks the “safe” area.

As the latest example of women-only transit, in the beginning of April the Guardian reported that there would be a new women-only rickshaw- service in Pakistan. The founder was fed up with facing daily harassment and now offers safe rides in pink rickshaws. I disagree with celebrating this business idea too much if the reason for the need of such women-only services is not sufficiently seen as a problem. We have to address the root causes.

Although I used to ride in the women-only carriage in Delhi and I guess it created a certain feeling of safety, I always felt like I was being put on display. Having all the women gathered in one space surrounded by men felt awkward. It is frustrating to know that these women-only spaces are a big move away from a gender equal society and from achieving real safety. Through sex-segregation, men do not need to adjust to a society in which women are equal and have the right to be in public spaces. The onus is on women to change.

In addition to women-only trains there are taxi services for women, which are even more widespread. There is SheRides in New York, Cab for Women by Women in Delhi and the Women´s Night Taxi in Hannover, Germany. In Germany there are also women-only parking lots, which are the ones closest to the building.

These interventions and businesses run by women create a safe option for women who otherwise might not go out or who will feel uncomfortable when they are out. As long as politics and culture fail women, this might be the only way to go. On the upside, in most cases it even provides women with economic empowerment. But of course even that is not perfect; the few female drivers may face safety issues as long as they are in the male-dominated space of taxi waiting lanes and rest areas.

Since January one of the major taxi companies in Delhi incorporated women drivers, catering to female passengers as well. This might be a small step forward. At least the men driving for this company will have to get used to having female colleagues.

In order for women to be safe, more women need to be out in public, as passengers and drivers.

Women in Pakistan leave jobs because of commuter harassment

Some women leave their jobs because of the street harassment they face during their commute, according to a new article about sexual harassment on public transportation in Islamabad, Pakistan.

“This single issue is directly damaging the careers of working women,” reads the article in Pakistan Today.

I’m not surprised. I know street harassment can significantly impact women’s lives. When I conducted an informal study of more than 800 women in 23 countries and 45 US states for my book research, 9 percent of women said they had changed jobs because of harassers along their commute and, related, street harassment had caused nearly 20 percent of the respondents to move neighborhoods.

What does the harassment in Pakistan look like?

“Street sexual harassment for a woman in public transport is similar to claustrophobia because she feels trapped in a small place with fear of no escape until she reaches her destination.

If a bus or train is crowded or if a woman is sitting by the window and the man harassing or assaulting her is sitting behind her, she cannot scream or raise her voice since most of the women do not want to get people’s attention in cases like these.

Faiza Bibi is a resident of Bhara Kahu which is a suburban area of the city and she has to travel daily using public transport to reach her workplace. She said most of the drivers harass female passengers; sometimes they even touch the female passenger sitting next to them on the front seats while pretending as if they were merely shifting the gear.

She complained that the behaviour of drivers, especially of the vans plying on the Route Number 127, was unbearable.

“Women have no other option since they have to sit on the front seats, next to the driver, because they are the only seats meant for women,” she explained.

She lamented that the drivers took advantage of the situation by harassing women; sometimes by touching, staring or playing loud vulgar songs but the women commuters usually avoided complaining to anyone because they felt too embarrassed to tell anybody.”

Of course Pakistan is not the only country with this problem. New York City, Boston, and Chicago all have PSA campaigns focused on sexual harassment on the buses and subways because studies showed more than 60 percent of riders faced harassment.

Many countries like Japan, India, and Brazil have women-only subway cars offered during rush hour because of the problem of sexual harassment and this is a “solution” Islamabad may turn to as well if they can get the finances for it. 92 percent of women surveyed there said they want to have women-only public transportation. But actually, what they probably want is just no harassment, not necessarily segregation. Since no one in the government seems to care about actually ending the harassment, segregation probably sounds appealing and certainly could be a short-term solution to offer them relief. But it will not fix the problem in the long run.

Fortunately, there are people speaking out against street harassment in Pakistan whose efforts may lead to more long-term change. One example is in Karachi, Pakistan, where a new NGO called Gawaahi creates media for awareness and advocacy. They recently produced two short video clips about street harassment in Pakistan as a way to start raising awareness about the problem.
